Copyright and terms and conditions for the use of Iconclass, the Iconclass
web site and the Iconclass server.



The term ‘Iconclass’ refers to the Iconclass iconographic classification
system developed by Henri van de Waal (1910-1972), Professor of Art History
at the University of Leiden, completed later by his staff, subsequently expanded
and edited by the Iconclass Research and Development Group at Utrecht University
and current editions of the Iconclass system published and maintained by the
Royal Netherlands Academy of Arts and Sciences (KNAW), hereafter referred
to as the KNAW. By referring to Iconclass, the reference includes all components
the Iconclass system disbributed in printed and in digital form, namely the
iconographic classification system, the hierarchical structure of the classification
system, the alphanumeric notations and textual correlates, cross references
within each component and between components of the Iconclass system, keywords,
alphabetical index and bibliography in all language versions.



The term ‘Iconclass web site’ refers to the official Iconclass web site accessible
under the url: http://www.iconclass.nl and all the content that is published
in the Iconclass web site.



The term ‘Iconclass server’ refers to the computerized version of Iconclass
and the user interface that is made available over the Internet by the KNAW.




The name Iconclass is a registered trademark owned by the KNAW and may not
be used as the title or name of any publication, website or product produced
in any media without the prior written permission of the KNAW.

 

All rights including copyright of Iconclass and the English and French language
versions of Iconclass are owned by the KNAW in all distribution and publication
forms including all printed and software versions distributed on the Iconclass
web site, Iconclass server and on CD-ROMs.



All rights including copyright of language versions of Iconclass other than
the English and French language versions of Iconclass are owned by the translator
and are distributed via the Internet, CD-ROMs or in print by the KNAW with
the permission of the copyright holder. The translator can own the copyright
only to a specific language version of Iconclass and does not own the copyright
to Iconclass itself. The translator is responsible for translating Iconclass
in its entirety and may not edit or expand Iconclass in any way that changes
any part of Iconclass and the components there of mentioned above. The translator
is permitted to reproduce, translate or distribute Iconclass only with written
permission from the KNAW and may do so only under the terms and conditions
agreed upon by both the KNAW as the copyright holder of Iconclass and the
translator as the copyright holder of a specific language version of Iconclass.
In turn, the KNAW is permitted to reproduce, translate or distribute translated
versions of Iconclass with the permission of the copyright holder of the specific
language version and under the terms and conditions agreed upon by both the
KNAW as the copyright holder of Iconclass and the translator as the copyright
holder of a specific language version of Iconclass.



The use of Iconclass in any language, edition or software version, for the
classification, search and retrieval of iconographic or visual material in
a published or publicly accessible collection of iconographic and/or visual
material both digital and non-digital requires the purchase of a license or
written permission from the KNAW. Edited, expanded and translated versions
of Iconclass may not be created and/or made publicly available except by the
KNAW or by persons and/or organizations authorized to do so by the KNAW. All
changes to Iconclass including all additions, changes, corrections and translations
are centrally managed by the KNAW or by persons and/or organizations that
are authorized by the KNAW to do so.



All rights including copyright of the contents of the Iconclass web site and
the Iconclass server are owned by the KNAW or licensed to the KNAW by the
contributor and copyright holder of the content or is used by the KNAW for
the Iconclass web site with the permission of the contributor and copyright
holder of the content. The KNAW prohibits the reproduction, translation and/or
distribution of any content from the Iconclass web site and the Iconclass
server without prior written permission from the KNAW. The KNAW prohibits
unauthorized linking of web applications to the Iconclass server that make
use of the Iconclass server as a search and retrieval instrument.

Except for licensed use of Iconclass described above, Iconclass content and
material from the Iconclass website, and the Iconclass server and the Iconclass
printed editions may not be copied, reproduced, republished, downloaded or transmitted
in any way except for private non-commercial use. Any other use requires the
prior written permission or purchase of a license from the KNAW. Iconclass and
Iconclass software may not be made publically available in any media without
prior written permission from the KNAW.

By using this web site and/or the Iconclass server, you are agreeing to the
terms and conditions stated here which are effective immediately on your first
use of the Iconclass web site and or the Iconclass server. By using Iconclass
for non-private use, in both commercial and non-commercial media in any way,
you are also agreeing to the terms and conditions stated here concerning the
use of Iconclass.



These terms and conditions shall be governed by and are in accordance with the
laws of the Netherlands. Disputes arising here from shall exclusively be subject
to the jurisdiction of the courts of the Netherlands.

The KNAW reserves the right to change its policy, terms and conditions concerning
the Iconclass web site and content, Iconclass server and access to Iconclass
software over the Internet, Iconclass system and software development, sales,
licensing and distribution at any time by posting changes online.
